Welcome to the Code3RV.com website (the “Website”). This Website is provided solely to assist customers in gathering travel information, determining the availability of travel—related goods and services, making legitimate reservations or otherwise transacting business with travel suppliers, sales of related goods and services, and for no other purposes. The terms “we”, “us”, “our”, “Code 3 RV” and “C3RV” refer to Code 3 RV, LLC., a California Limited Liability Corporation. The term “you” refers to the customer visiting the Website and/or booking a reservation through us on this Website, or through our customer service agents.
As a condition of your use of this Website, you warrant that:
You are at least 18 years of age;
You possess the legal authority to create a binding legal obligation;
You will only use this Website to make legitimate reservations for you or for another person for whom you are legally authorized to act;
All information supplied by you on this Website is true, accurate, current and complete; and
Code 3 RV is committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns. But if we are unsuccessful, you may pursue claims as explained in this section.
Arbitrations will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA Consumer Rules. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules, except as provided in this section. If your total Claims seek less than $10,000, we will reimburse you for filing fees you pay to the AAA and will pay arbitrator’s fees. You may choose to have an arbitration conducted by telephone, based on written submissions, or in person in the state where you live or at another mutually agreed location.
To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your Claims to “Code 3 RV, ATTN: Legal Department: Arbitration Claims,” at Code 3 RV, LLC., 42046 Rio Nedo Road, Temecula, CA 92590. If we request arbitration against you, we will give you notice at the email address or street address you have provided. The AAA’s rules and filing instructions are available at www.adr.org or by calling 1-800-778-7879.
Any and all proceedings to resolve Claims will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a Claim proceeds in court rather than in arbitration we each waive any right to a jury trial. The Federal Arbitration Act and federal arbitration law apply to this agreement. An arbitration decision may be confirmed by any court with competent jurisdiction.
The content and information on this Website (including, but not limited to, price and availability of rental services) as well as the infrastructure used to provide such content and information, is proprietary to us or our suppliers and providers. While you may make limited copies of your booking itinerary (and related documents) for travel or service reservations booked through this Website, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through this Website. Additionally, you agree not to:
Use this Website or its contents for any commercial purpose;
Make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;
Access, monitor or copy any content or information of this Website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
Violate the restrictions in any robot exclusion headers on this Website or bypass or circumvent other measures employed to prevent or limit access to this Website;
Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
Deep—link to any portion of this Website (including, without limitation, the purchase path for any travel services) for any purpose without our express written permission; or
“Frame”, “mirror” or otherwise incorporate any part of this Website into any other website without our prior written authorization.
If your booking or account shows signs of fraud, abuse or suspicious activity, Code 3 RV may cancel any rental or service reservations associated with your name, email address or account, and close any associated Code 3 RV accounts. If you have conducted any fraudulent activity, Code 3 RV reserves the right to take any necessary legal action and you may be liable for monetary losses to Code 3 RV, including litigation costs and damages. To contest the cancellation of a booking please contact Code 3 RV Customer Service.
The price of services will be as quoted on the website from time to time, except in cases of obvious error. Prices are liable to change at any time, but changes will not affect bookings already accepted. Despite Code 3 RV’s best efforts, some of the services listed on the website may be incorrectly priced. CODE 3 RV EXPRESSLY RESERVES THE RIGHT TO CORRECT ANY PRICING ERRORS ON OUR WEBSITE AND/OR ON PENDING RESERVATIONS MADE UNDER AN INCORRECT PRICE. IN SUCH EVENT, IF AVAILABLE, WE WILL OFFER YOU THE OPPORTUNITY TO KEEP YOUR PENDING RESERVATION AT THE CORRECT PRICE OR WE WILL CANCEL YOUR RESERVATION WITHOUT PENALTY. Code 3 RV is under no obligation to provide services to you at an incorrect (lower) price, even after you have been sent confirmation of your booking.
You authorize Code 3 RV to book reservations for the total reservation price, which includes the daily rate displayed on the Website, plus any and all taxes & fees, and add-ons where applicable. You agree that your credit card will be charged by Code 3 RV for the total reservation price. Upon submitting your reservation request you authorize Code 3 RV to charge your credit card for the total reservation price, including any applicable credit card transaction and/or merchant processing fees.
You can change or cancel your booking either online under your booking or by calling our customer service agents at 855-331-2378.
You can change your guest name, vehicle, special requests, add-on packages, number of guests and travel dates once at no charge to you, depending on availability. Price may change due to seasonal pricing. If you must cancel your booking, there are cancellation fees that may be assessed in accordance with Code 3 RV’s cancellation policy.
In the event that Code 3 RV is unable to honor your booking, Code 3 RV will properly accommodate any suitable replacements at its discretion or refund your booking in full. If you do not show for the first day of your reservation, the whole booking may be cancelled. These terms and conditions may not be changed by any unauthorized person, including employees of Code 3 RV.
Discount and/or promo codes (“Coupons”) may be applied to pre-paid bookings, excluding bookings occurring during holidays and special events.
Coupons with a discount in a specific currency (e.g. 10 Euro off) cannot be used for bookings paid for in a different currency.
If the discount is based on a percentage (e.g. 10% off), in the case of booking of multiple vehicles (i.e., when you book 2 or more vehicles in the same booking) the discount only applies to the price of the first vehicle included in the booking request.
Only one Coupon per booking may be used. Usual booking terms and conditions apply and all bookings are subject to availability. Coupons cannot be sold, transferred, or redeemed for cash.
All taxes, fees, charges, and surcharges are applicable to reservations made using Coupons. These charges must be paid at the time of the reservation. Coupons have value only when redeemed in accordance with all terms and conditions of the offer.
Single-use Coupons will be deemed fully used once a qualifying reservation has been made and will not be returned or replaced and there will be no refund if a Coupon is redeemed in part. Multiple-use Coupons will be deemed fully used in accordance with the restrictions set out in the individual Coupon terms and conditions.
If the travel dates are changed after the use of a Coupon, then that Coupon will not apply to the changed travel schedule. Coupons may not be used for any previously purchased reservation. Coupons cannot be used in conjunction or combination of other discounts. Code 3 RV reserves the right to vary these conditions of use or to withdraw Coupons at any time.
Code 3 RV currently accepts VISA, MasterCard, Discover and American Express Card and has negotiated contracts for processing payment card transactions.
Many bank and credit card companies charge their account holders a transaction fee when the card issuer and the merchant location (as defined by the card brand [e.g. Visa, Discover, MasterCard, American Express]) are in different countries. The currency exchange rate, if applicable, and any transaction fee are determined solely by the bank or other agency processing the transaction. These fees may be applied by the card issuer as a charge to the cardholders account. This means the amount listed on your credit or debit card statement may be a different figure than the figure shown on the billing summary page for a reservation booked on this Website. If you have any questions about these fees or any exchange rate applied to your booking, please contact your bank.
Each payment card transaction may have an associated fee charged by the credit card company. These are fees that are charged by the credit card company and by the merchant processing company. Code 3 RV is not responsible for the amount that these fees are.
When a good or service is purchased using a credit card and a refund is necessary, the refund must be credited back to the account that was originally charged. Refunds in excess of the original sale amount or cash refunds are prohibited. If the good or service was purchased in cash and a refund is necessary, it is at Code 3 RV’s discretion to issue a refund via check.
If you believe in good faith that materials hosted by us infringe your copyright, you (or your agent) may send us a written notice that includes the following information. Please note that we will not process your complaint if it is not properly filled out or is incomplete. Any misrepresentations in your notice regarding whether content or activity is infringing may expose you to liability for damages.
1. A clear identification of the copyrighted work you claim was infringed.
2. A clear identification of the material your claim is infringing is on the Website, such as a link to the infringing material.
3. Your address, email address and telephone number.
4. A statement that you have a “good faith belief that the material that is claimed as copyright infringement is not authorized by the copyright owner, its agent, or the law.”
5. A statement that “the information in the notification is accurate, and under penalty of perjury, the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
6. A signature by the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
